1. Acceptance of these terms

By accessing or using Elevyn, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use Elevyn.

2. Eligibility

You must be at least 13 years old to use Elevyn. Users under 18 should use Elevyn only with permission from a parent or legal guardian.

By using Elevyn, you represent that you meet these eligibility requirements and have the legal capacity to accept these terms.

3. Your account

You may create an account using email, Sign in with Apple, or Google Sign-In. You are responsible for maintaining the security of your account and for activity that occurs through it.

You agree to provide accurate information and promptly update it when necessary. You may not use another person’s account without authorization.

4. Fitness and nutrition disclaimer

Elevyn provides general fitness, workout, nutrition, and wellness information for educational and informational purposes only.

Elevyn is not a medical provider and does not provide medical advice, diagnosis, treatment, emergency services, or professional nutritional care.

Consult a qualified healthcare professional before beginning or changing an exercise or nutrition program, especially if you have an injury, medical condition, pregnancy, physical limitation, or other health concern.

5. Assumption of risk

Exercise and changes to diet involve inherent risks. You are responsible for evaluating your own condition, abilities, and surroundings before performing any activity suggested through Elevyn.

Stop exercising and seek appropriate medical attention if you experience pain, dizziness, faintness, breathing difficulty, or other concerning symptoms.

6. AI-generated content

Certain Elevyn features use artificial intelligence to generate workouts, coaching responses, fitness suggestions, nutrition guidance, and other content.

AI-generated content may be incomplete, inaccurate, or unsuitable for your circumstances. You are responsible for reviewing and evaluating it before relying on or acting on it.

AI features are not a substitute for professional medical, fitness, legal, financial, or nutritional advice.

7. Subscriptions and purchases

Elevyn may offer free and paid features. Paid subscriptions are purchased through the Apple App Store or Google Play and are governed by the applicable store’s billing terms.

Unless canceled before renewal, subscriptions may renew automatically at the price shown at the time of purchase or renewal.

You can manage or cancel your subscription through your Apple or Google account settings. Deleting Elevyn or deleting your Elevyn account does not automatically cancel an active store subscription.

8. Trials and promotional offers

Elevyn may offer free trials, introductory pricing, discounts, or promotional access. Eligibility, duration, renewal terms, and pricing will be shown when the offer is presented.

Promotional offers may be modified, limited, or discontinued where permitted by law.

9. Refunds

Purchases made through the App Store or Google Play are processed by Apple or Google. Refund requests must generally be submitted through the store where the purchase was made and are subject to that store’s refund policies.

10. Acceptable use

You agree not to:

• Use Elevyn for unlawful, harmful, or fraudulent purposes
• Attempt to access another user’s account or information
• Interfere with the security or operation of Elevyn
• Reverse engineer or improperly copy the service
• Upload malicious code or attempt unauthorized access
• Use automated systems to scrape or overload the service
• Misrepresent your identity or account information
• Use Elevyn to generate content that violates applicable law or the rights of others

11. User content and inputs

You retain ownership of information and content you submit to Elevyn, such as profile information, workout logs, nutrition entries, preferences, and AI prompts.

You grant Elevyn a limited right to process that information as necessary to operate, personalize, secure, and improve the service.

You are responsible for ensuring that your submissions are lawful and do not violate the rights of another person.

12. Intellectual property

Elevyn, including its software, branding, design, interfaces, graphics, text, features, and original content, is owned by or licensed to Elevyn and is protected by applicable intellectual property laws.

These terms grant you a limited, personal, non-exclusive, non-transferable, revocable right to use Elevyn for its intended purpose.

13. Third-party services

Elevyn may rely on or connect with third-party services, including Apple, Google, Firebase, Amazon Web Services, RevenueCat, OpenAI, and Expo.

Your use of third-party services may also be subject to their own terms and privacy policies. Elevyn is not responsible for third-party services outside our control.

14. Availability and changes

We may modify, update, suspend, restrict, or discontinue any part of Elevyn at any time. We do not guarantee that Elevyn will always be available, uninterrupted, secure, or error-free.

15. Account suspension and termination

We may suspend or terminate access to Elevyn if we reasonably believe that a user has violated these terms, created a security risk, misused the service, or engaged in unlawful activity.

You may stop using Elevyn at any time and may delete your account through the app.

16. Disclaimer of warranties

To the fullest extent permitted by law, Elevyn is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory.

We do not guarantee specific fitness, health, weight, strength, performance, or nutrition results.

17. Limitation of liability

To the fullest extent permitted by law, Elevyn and its owners, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of or inability to use Elevyn.

Nothing in these terms excludes liability that cannot lawfully be excluded or limited.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Elevyn and its affiliates from claims, losses, liabilities, damages, and expenses arising from your misuse of Elevyn, violation of these terms, or violation of another person’s rights.

19. Governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where consumer-protection law requires otherwise.

20. Changes to these terms

We may update these Terms of Use from time to time. The updated version will be posted on this page with a revised “Last updated” date.

Continued use of Elevyn after an update becomes effective means that you accept the revised terms.
